The US Supreme Court has handed President Donald Trump and Republicans a victory in a dispute over discounted political advertising rates ahead of the November midterm elections, allowing federal regulators more time to review a Democratic challenge to the rules.

In a 7-2 emergency decision on October 16, the court blocked a lower court order requiring the Federal Communications Commission (FCC) to rule within 48 hours on a petition challenging its revised advertising policy.

The decision allows the FCC to continue reviewing the challenge without the deadline imposed by the US Court of Appeals for the Fourth Circuit. Justices Sonia Sotomayor and Ketanji Brown Jackson dissented, saying they would have rejected the Trump administration’s emergency request, although they did not provide further explanation.

The Supreme Court criticised the lower court’s attempt to impose a deadline on the commission while its deliberations were ongoing.
